　　据介绍，2006年3月，常飞航在中国农业银行股份有限公司伊川县支行（以下称农行伊川县支行）办理了 一张金穗通宝卡，2009年3月15日凌晨1时38分，正在熟睡中的常飞航被一阵短信铃声吵醒。常飞航查看 短信发现，自己的银行卡在某取款机上被取出了2500元。

　　紧接着，又来了10余条短信，短信显示，常飞航卡里的钱被连续支取6次，另扣除手续费12元，共计14 012元。常飞航看到短信后，发现自己的银行卡还在口袋里，便拨打110报了警。

　　2009年3月20日，常飞航向伊川县公安局刑侦大队报案，警方立案侦查，但案件至今尚未侦破。200 9年8月，常飞航决定向伊川县人民法院起诉农行伊川县支行。

　　一审持卡人诉讼请求被驳回

　　得知常飞航要和银行打官司的消息，周围的邻居、亲戚朋友并不是很支持。常飞航说：“他们有人说‘你的卡 都办了3年了，说不定在这期间是你无意间泄露了密码。’还有人说‘即便跟你没关系，你一个普通老百姓和银行 打官司，怎么会赢呢？’”但常飞航认为：“我使用农行的银行卡，在卡还在我身上的情况下，卡里的万余元居然 不翼而飞，是银行管理不善，才导致我的资金被他人支取。”

　　2009年10月16日，伊川县人民法院开庭审理此案。在审理过程中，农行伊川县支行承认常飞航存款、 取款的事实。但农行伊川县支行也提出：常飞航存款被他人支取的原因，并不能完全确定为我行管理不善所致。原 告在我行存款3年多的时间里，不排除对储蓄卡使用不当或自行泄密的可能。

　　伊川县人民法院判决：驳回原告常飞航的诉讼请求。 常飞航不服判决，决定向洛阳市中级人民法院提出上诉。

　　终审持卡人胜诉 银行赔钱

　　2010年4月7日，常飞航向洛阳市中级人民法院提出上诉，请求洛阳市中级人民法院撤销伊川县人民法院 判决，并提出农行伊川县支行支付储蓄存款14012.09元及利息费用等诉讼请求。2010年7月26日， 洛阳市中级人民法院开庭审理。

　　农行伊川县支行辩称：上诉人常飞航在我行存款三年多的时间里，其本人存取款情况完全正常，没有异常现象 ，因此上诉人常飞航的损失我行不应承担；根据“谁主张，谁举证”的原则，上诉人常飞航有举证我行存在过错的 责任，但上诉人常飞航并没有证据证明；常飞航一审提供证据说明其银行卡资金被盗，已经作为刑事案件在公安部 门立案，应待刑事案件侦破后，来界定彼此的民事责任；上诉人常飞航承认到公安局报案的事实，说明上诉人常飞 航的损失应由犯罪人来承担，不应由被上诉人农行伊川县支行承担。

　　经过审理，洛阳市中级人民法院认为：农行伊川县支行作为经营存、贷款等业务的专业金融机构，负有保证储 户存、取款安全的义务，其未针对自助银行的特点，尽到安全维护的义务，应负全部责任。常飞航在自助银行按照 正常程序办理业务的过程中，其本人并不存在过错，不应承担责任。本案系储蓄存款合同纠纷，第三人是否犯罪以 及如何追究第三人责任的问题与本案的民事处理无关，本案民事部分的审理并不涉及刑事部分处理，农行伊川县支 行不能以第三人的犯罪来免除自己的民事责任，故本案无需等待刑事案件审理完毕再进行审理。故被上诉人的抗辩 理由，于理于法均无据，本院不予支持。

　　2010年8月30日，洛阳市中级人民法院作出终审判决：撤销一审判决；中国农业银行股份有限公司伊川 县支行于终审判决生效后10日内赔偿常飞航银行卡存款损失14012元；驳回常飞航的其他上诉 请求。
