　　对于检方指控的1000多万元资金只有一部分进入期货账户，区志存解释是要“分期分批的投入”，所以这 部分钱是用来循环使用的，并非他故意截留诈骗。
　　庭上，区志存拒不认罪，他辩称自己并非要故意诈骗，而是因为2008年金融风暴期间，期货铜价格暴跌， 导致他操作的期货账户爆仓，资金都亏了，所以无法兑现 对客户的承诺。他从1993年就开始炒期货，而且炒得很好,4代苹果监听器，一直到2007年都基本维持盈利状态。在这些年里，他积累了很多客户,手机窃听器咨询，这些客户都与他签订了私下协议，将资金交给他来炒期货，他则承诺百分之百盈利，一般按照40%至60%的 利润回报承诺对方。在案发之前，他对客户的承诺基本上都兑现了，而2008年金融风暴时，期货市场遭遇了前 所未有的打击，账户中炒作期货铜的资金很快被平仓。
　　检察官出示的证据则显示，区志存在与客户签订协议时的担保公司均不承认为其担保，他提供的六处房产均不 是本人的，而且区志存所采取的私募行为是违反相关规定的。



　　【检方指控】

　　对于区志存所称的期货爆仓事实，从其所操盘的期货账户来看，除了一个账户总体亏本80多万元外，另外一 个账户甚至是盈利的，而银行的进出账单却显示，他确实收到了1000万元的资金，这些钱既然没有全部亏空， 那么都去了哪里呢？

　　2007年6月至2008年12月，被告人区志存以非法占有为目的，分别与多名被害人签订合同炒期货。 区志存在合同中许诺高比例的回报,手机监听器货到付款，加盖深圳市新茂实业发展有 限公司或深圳市科钛实业发展有限公司的假公章作担保，或将他人的房产谎称是自己的作担保，骗取10名被害人 共1091万元。区志存案发前仅归还被害人 365.18万元。检察机关认为，应以合同诈骗罪追究区志存的刑事责任。
　　检察官：钱没全亏却“不翼而飞”
