医院因医疗过失致女婴脑瘫被判赔159万
 

　　新华网石家庄9月30日电(记者朱峰)河北省邯郸市一家医院的医护人员给产妇做手术后，因医疗过失导致 女婴出生后脑瘫。记者30日从河北省高级人民法院获悉，该院日前对这件罕见的医疗损害赔偿纠纷案作出二审判 决，驳回双方当事人上诉，维持原审关于医院赔偿女婴人民币159万多元的判决。

　　据邯郸市中级人民法院一审判决认定，2004年10月28日，梁某入住邯郸一家医院妇产科待产。29日 凌晨，医护人员为梁某做了侧切手术，随后医护人员却在为另一位产妇接产后又返回为梁某接产，产下一女婴初诊 为缺氧缺血性脑病。2005年1月，女婴入住北京大学第一医院治疗，入院诊断为：智力运动发育落后。出院诊 断为：智力、运动、发育落后，癫痫，缺氧缺血性脑病后遗症期。2005年11月北京博爱医院诊断证明为：脑 性瘫痪，痉挛型四肢瘫极重度；头小畸形；智力、语言、视觉损伤；癫痫。

　　邯郸市中级人民法院认为，依据西南政法大学司法鉴定中心作出的鉴定结论和补充鉴定意见，确认被告医院在 对梁某接产过程中存在着医疗过失行为，其过失行为与女婴缺血缺氧性脑病乃至目前脑瘫表现存在着因果关系，应 认定医疗方过错因素是导致患儿脑瘫后果的主要因素。产妇梁某在做侧切术后，医院产科医生应及时为产妇接产， 却耽搁一段时间后才为梁某接产，致使女婴宫内窒息，造成缺氧缺血性脑病后遗症，存在重大过错。

　　依照《中华人民共和国民法通则》、《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》的 有关规定，邯郸市中级人民法院判决医院支付梁某及女婴医疗费、护理费、残疾赔偿金、精神损害抚慰金等共计1 594498.5元,louis vuitton。

　　原告、被告均不服一审判决，向河北省高级人民法院提起上诉。河北省高级人民法院近日认为，一审认定事实 清楚，适用法律正确，应予维持，并依照《中华人民共和国民事诉讼法》的有关规定作出判决：驳回上诉，维持原 判。
